Terms of Service

1. Agreement to Terms

By accessing or using Veluce ("Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. The contracting entity operating the Service is established in Wyoming, United States. We may modify these Terms at any time; continued use after changes constitutes acceptance.

2. Service Description

Veluce provides digital tools and services, including: (a) Secure Access subscription services available for purchase on this site, and (b) informational showcases for additional products such as AI Plans and Phone (this site does not offer purchasing, pricing, or inventory for these products). We do not provide general-purpose VPN services for circumventing legal restrictions, and we do not authorize use of our services to violate third-party platform rules or applicable law.

3. Eligibility & Account

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Accounts may not be shared between users โ€” one account = one individual or one legally registered entity. Any violation of this requirement will result in immediate termination. Service availability may be restricted where required by applicable law.

4. Acceptable Use Policy (AUP)

  • โ€บYou agree NOT to use the Service for any illegal activity under applicable law.
  • โ€บYou agree NOT to use the Service to engage in fraud, phishing, carding, or identity theft.
  • โ€บYou agree NOT to share, resell, or sublicense your account or Endpoints to third parties without our express written consent.
  • โ€บYou agree NOT to use the Service to conduct automated attacks, credential stuffing, or scraping at volume against third-party platforms.
  • โ€บYou agree NOT to use the Service to violate the ToS of third-party platforms in ways that expose Veluce to liability.
  • โ€บYou agree NOT to use the Service for harassment, transmitting illegal content, or any activity that harms third parties.
  • โ€บVeluce reserves the right to terminate any account found in breach of this AUP without refund, except where mandatory law requires otherwise.

5. AI Shield Guarantee

Veluce offers an AI Shield Guarantee for Pro, Ultra, and Team plan subscribers. Under this Guarantee, if your AI platform account (e.g., Claude, ChatGPT, Gemini) is suspended solely and directly because a Veluce-provided IP address was flagged by that platform's risk engine, you are eligible for compensation in the form of an equivalent service credit extension and, subject to evaluation, compensation for documented account value loss.

5.1 Claim Requirements

To submit a valid claim, you must provide all of the following within 30 days of the suspension: (a) a screenshot of the ban notification, (b) the appeal result explicitly citing IP-related causes, and (c) the billing history page showing your active subscription with the relevant AI platform. Claims missing any of these elements will not be processed.

5.2 Exclusions

The AI Shield Guarantee does NOT apply to account suspensions resulting from: (a) violation of the AI platform's own Terms of Service; (b) account sharing or multi-user access; (c) API abuse, model distillation, or automated mass request behavior; (d) regional policy-based restrictions (e.g., blanket restrictions on entity types unrelated to IP reputation); (e) use of the platform in ways explicitly prohibited by that platform; or (f) accounts that were already under review or restricted prior to using Veluce.

5.3 Compensation Cap

Service credit is capped at one equivalent billing cycle per claim. Any cash-equivalent compensation for documented platform subscription loss is capped at the equivalent USD retail price of the AI platform subscription at time of ban, as substantiated by the billing proof provided. Veluce does not compensate for indirect losses, business disruption, or lost productivity.

6. Payment & Cancellations

Pricing, currency, product type (recurring or one-time), and billing cadence are shown at checkout or order confirmation. Where third-party payment processors are used (including Stripe, when enabled), payment processing is subject to their terms and technical availability.

6.1 Recurring vs One-Time Products

Secure Access plans are offered as recurring subscriptions on this site. This site does not currently sell AI Plans or Phone products.

6.2 Renewal & Cancellation

Recurring subscriptions renew only when renewal terms are explicitly presented and accepted. You may cancel before the next renewal cycle to stop future charges. Cancellation does not retroactively refund already consumed service periods, except where mandatory law requires otherwise.

6.3 Consumer-Law Carve-Out

If your jurisdiction grants non-waivable consumer rights (including cooling-off/withdrawal rights), those rights apply and prevail over conflicting terms in this Agreement. For digital services or digital content that begin immediately at your request, you agree that access/delivery may start before the withdrawal period ends, and your withdrawal right may be reduced or lost to the extent permitted by applicable law once performance has begun or completed.

7. Service Availability

We target 99.9% uptime for the Service, but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. Downtime caused by third-party infrastructure, ISP issues, or force majeure events is excluded from any SLA claims. Pro, Ultra, and Team plans receive priority incident response.

8. Intellectual Property

All content, trademarks, software, and infrastructure comprising the Veluce platform are the property of Veluce and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for its intended purpose.

9. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. VELUCE IS NOT RESPONSIBLE FOR ACTIONS TAKEN BY THIRD-PARTY PLATFORMS (INCLUDING ACCOUNT BANS OR RESTRICTIONS) EXCEPT AS SPECIFICALLY COVERED BY THE AI SHIELD GUARANTEE IN SECTION 5. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELUCE'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM.

10. Termination

Veluce may suspend or terminate your account at any time for violation of these Terms, without notice and without refund except where mandatory law requires otherwise. You may terminate your account at any time through the dashboard. Upon termination, your right to use the Service ceases immediately.

11. Governing Law, Arbitration & Class Action Waiver (Draft)

This Section 11 is provided as a lawyer-review draft for procedural clarity and may be updated after external counsel final review.

11.1 Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, and applicable U.S. federal law, without regard to conflict-of-law rules.

11.2 Pre-Arbitration Notice

Before filing arbitration, each party agrees to provide written notice of the dispute and attempt good-faith resolution for at least 30 days. Notices should be sent to legal@veluce.io (for Veluce) or to the account email on file (for users).

11.3 Binding Arbitration (AAA)

If informal resolution fails, disputes will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules. The arbitration seat is Wyoming, United States, unless mandatory law requires another venue.

11.4 Class Action & Jury Trial Waiver

To the maximum extent permitted by law, disputes must be brought only on an individual basis. You and Veluce waive any right to participate in class, collective, representative, or private-attorney-general actions, and waive jury trial rights for covered disputes.

11.5 Exceptions & Non-Waivable Rights

Either party may seek relief in small claims court where eligible, and may seek injunctive relief for intellectual-property misuse or security abuse. If any part of this Section 11 is unenforceable, the remaining provisions survive to the fullest extent permitted by law. Non-waivable consumer rights remain unaffected.
